The Creators Road · Legal
Terms & Conditions
Clear expectations for using our website and working with us on custom apps, automation and related services.
1. About These Terms
These Terms and Conditions (“Terms”) govern use of thecreatorsroad.com (the “Website”) and, where applicable, services provided by Radiant Road Media LLC, operating as The Creators Road (“Company,” “we,” “us,” or “our”). Services may include custom software and web application design, configuration, installation, integrations, lead-notification tools, and related support (collectively, “Services”).
By using the Website, you agree to these Terms. For paid Services, your accepted proposal, order form, invoice terms, statement of work, or separately signed agreement (“Service Order”) also applies. If a Service Order expressly conflicts with these Terms, the Service Order controls for that project. Nothing here replaces mandatory legal rights that cannot lawfully be excluded.
2. Eligibility and Business Use
You must be at least 18 years old and legally able to enter into an agreement. When acting for a business, you represent that you are authorized to bind that business. Services are primarily intended for business use; any applicable consumer protections remain unaffected.
3. Quotes, Scope and Changes
A Service Order should identify the deliverables, functionality, integrations, project fees, recurring fees (if any), timing assumptions and any ongoing support. Work outside the agreed scope—including additional features, revisions, integrations or major changes—may require an additional quote and your approval before we undertake that work.
You agree to supply accurate information, content, access credentials through reasonably secure means, timely feedback and any approvals needed to complete the work. Project schedules may be adjusted where delays arise from missing client materials, third-party services, changed requirements or other circumstances beyond our reasonable control.
4. Fees, Invoices and Payment
Fees, currency, payment milestones, due dates and any taxes will be stated in your Service Order or invoice. You agree to pay valid invoices according to those terms. We may postpone work that has not begun, or suspend affected Services for materially overdue payments after reasonable notice and an opportunity to resolve the issue, except where immediate action is reasonably required for security or legal reasons.
Any third-party charges—such as hosting, domain registration, messaging usage, AI tools, payment processing or software subscriptions—are your responsibility only when disclosed in the Service Order or separately authorized by you. We will not impose an undisclosed recurring fee merely through these Website Terms.
5. Recurring Services and Cancellation
Hosting, maintenance, support, software access or other recurring Services apply only if specifically included in your Service Order. The Service Order must state the billing amount, frequency, term, renewal arrangement and cancellation method. No automatic renewal is created by these Terms alone.
You may request cancellation at tanya@thecreatorsroad.com. Cancellation takes effect according to the applicable Service Order and any mandatory law. Fees already earned for delivered or performed work are not automatically refunded; any refund, credit or remaining commitment is determined by the Service Order and applicable law.
6. Review, Delivery and Support
We will provide the agreed deliverables and a reasonable opportunity for you to review them as specified in the Service Order. You should report material discrepancies against the agreed scope promptly so they can be assessed. Any included revisions, acceptance tests, warranty period, response targets, ongoing maintenance, updates, backups and technical support must be stated in the Service Order; they are not unlimited by default.
No website, app, integration or third-party platform can be guaranteed to be continuously available, uninterrupted or free of defects. We will exercise reasonable care and skill in providing our Services, subject to any additional enforceable commitments in the Service Order.
7. Software Ownership and Licence
Unless a Service Order expressly provides otherwise, we and our licensors retain ownership of our pre-existing materials, methods, templates, frameworks, reusable components, tools, know-how and underlying software, including modifications or improvements to them (“Provider Materials”). Subject to your payment of applicable fees and compliance with the Service Order, we grant you a non-exclusive, non-transferable licence to use Provider Materials only as embedded in or necessary to use your agreed deliverables for your internal business purposes during the applicable licence or service term.
You retain ownership of your logos, trademarks, copy, customer lists and other materials you provide (“Client Materials”). You give us a limited licence to use Client Materials as needed to perform the Services. Ownership or assignment of any new, bespoke deliverable, source code, design files or other intellectual property is determined by the Service Order; paying an invoice does not by itself transfer underlying source code or Provider Materials. Third-party components remain subject to their respective licences.
8. Your Content and Lawful Use
You are responsible for the accuracy, legality and rights to use your Client Materials, marketing content, contact lists, lead forms and instructions. You must not use the Services to send spam, deceive recipients, infringe intellectual property, unlawfully collect personal data, transmit malicious code or otherwise violate applicable law. We may restrict unlawful or materially abusive activity where reasonably necessary.
9. Leads, Communications and Data Protection
Some Services may receive, process, score, route or notify you about sales enquiries and other personal information. As between the parties, you determine the purposes and lawful basis for collecting and using your customers’ or prospects’ information, and you are responsible for appropriate notices, permissions, opt-outs and compliance with applicable privacy, telemarketing, SMS, email, recording and marketing laws. Using an automated workflow does not establish consent to contact a person.
We will process information made available to us for the purpose of providing the agreed Services, under the applicable contract and any required data processing agreement. We will use reasonable safeguards proportionate to the Services, but no system can promise absolute security. Responsibilities for hosting, access controls, retention, backups, breach notifications, data exports and deletion should be documented in the Service Order or a separate data processing agreement where required. Do not provide highly sensitive information unless its processing has been expressly agreed.
10. AI Outputs and Automated Recommendations
Where the Services use artificial intelligence to classify enquiries, produce lead scores, draft messages or suggest sales responses, results can be inaccurate, incomplete or unsuitable. You are responsible for human review and for decisions, communications and actions taken using those outputs. We do not guarantee any particular response time, lead conversion rate, revenue increase or commercial result.
11. Third-Party Platforms and Integrations
Services may depend on external platforms, APIs, hosting, email providers, telephone/SMS vendors, AI providers or other services we do not control. Availability, pricing, features, policies and access may change. Each third-party provider may require its own terms or account. We are not responsible for disruptions caused solely by third parties outside our reasonable control, but will perform any support obligations specifically agreed in the Service Order.
12. Confidentiality
Each party will use reasonable care to protect non-public business, technical and customer information received from the other party, use it only for the agreed business purpose, and disclose it only to people or service providers who reasonably need it and are subject to suitable confidentiality obligations. This does not cover information that is public through no breach, independently developed, lawfully received without restrictions, or required to be disclosed by law.
13. Suspension and Termination
We may suspend access where reasonably necessary to address a serious security threat, unlawful use or material breach, with advance notice when reasonably practicable. Either party may end paid Services according to the applicable Service Order and mandatory law. Termination does not automatically erase accrued payment obligations or rights that by their nature continue.
On termination, data access, export, retention, deletion, continued hosting and transition support are governed by the Service Order, any applicable data processing agreement and applicable law. Clients should arrange any needed exports before service access ends.
14. Warranties and Disclaimers
We aim to provide Services with reasonable care and skill. Except for express promises in a Service Order and rights that cannot lawfully be excluded, the Website and general informational content are provided on an “as available” basis. We do not warrant that any particular app will be suitable for every business, that all integrations will remain compatible, or that any specific sales outcome will occur.
15. Liability
To the fullest extent permitted by applicable law, neither party is liable to the other for indirect or consequential losses, including lost profits or business opportunities, arising from these Terms or the Services. Subject to the exceptions below, our aggregate liability arising from a paid Service is limited to the fees actually paid to us for the specific affected Service during the 12 months preceding the event giving rise to the claim; for Website-only use with no paid Service, our aggregate liability is limited to US $100.
These limits do not apply where prohibited by law, or to fraud, willful misconduct, or liability that cannot legally be excluded or limited. Nothing limits your obligation to pay valid fees owed. Any separately negotiated liability terms in a Service Order will control.
16. Website Links and Intellectual Property
The Website may link to independent sites. We do not control their content, terms or privacy practices. The Creators Road name, branding and Website content are owned by us or used with permission and may not be copied or reused without authorization, except as permitted by law.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules, except where mandatory law requires otherwise. Before bringing a formal claim, you agree to contact us and make a good-faith attempt to resolve the matter informally. Any court proceedings are subject to the jurisdiction and venue rules that applicable law permits. This provision does not deprive consumers of non-waivable legal protections.
18. Privacy Policy
Our separate Privacy Policy explains how we handle personal information collected through the Website and our own business operations. Client lead data processed inside a custom application may also require a client-facing privacy notice and separate contractual data processing terms. Add a working link to the Website Privacy Policy before publishing this page.
19. Changes to Terms
We may update these Website Terms and change the “Last updated” date. Material changes affecting an ongoing paid Service will be handled under the applicable Service Order and mandatory law; posting new Website Terms alone does not retroactively replace a signed commercial agreement. Continued use of the Website after an update may signify acceptance where legally permissible.
